An armed conflict with China within our lifetime

According to Supreme Court Associate Chief Justice Antonio Carpio, China’s invasion and occupation of Mischief Reef in 1995, and its unilateral grab of Scarborough Shoal (or Bajo de Masinloc) in 2012, are acts of armed aggression against the Philippines that violate the United Nations Charter.

It has taken over Mischief Reef, Mabini Reef, Malvar Reef, Calderon Reef, Gavin Reef and Bajo de Masinloc. China is also blockading the area around Ayungin Shoal with intent to evict the Marines on board the RPS Sierra Madre. All these are within our exclusive economic zone (EEZ) and extended continental shelf (ECS) accorded by the United Nations Convention on the Law of the Sea (or UNCLOS) that we refer to as the West PH Sea.

We have been trying to bring China to dialogue and resolve the dispute since 1995 when it snatched Mischief Reef away from us. However, China agrees only on the condition that we recognize…
